How long do I have to respond to a debt collection lawsuit in California?
In most cases you have 30 days after you are served to file a written response with the court. The deadline can be different depending on how you were served, so act quickly and have a lawyer check your dates.
What happens if I ignore the lawsuit?
The creditor can ask the court for a default judgment. With a judgment, it may be able to garnish your wages or levy your bank account. Responding on time keeps your defenses open.
Can a debt buyer sue me for an old debt?
Debt buyers can sue, but California law requires them to have specific documents proving the debt and their ownership of it, and they cannot sue on debts past the statute of limitations.
What is the statute of limitations on debt in California?
For most consumer debts based on a written agreement, the limit is generally four years. The exact period depends on the type of debt and when the last payment was made.
Can I still settle after I have been sued?
Yes. Many collection cases settle after the lawsuit is filed. Filing a response first protects you while settlement is negotiated.
Is debt settlement right for me?
It depends on the amount owed, your income and assets, and whether you have a lawsuit pending. We review your situation and explain your options before you decide.
Can a collector call me at work or threaten me?
Federal and California law, including the Fair Debt Collection Practices Act and the Rosenthal Act, prohibit abusive, deceptive, and harassing collection practices.
Do I have to go to court in person?
Not always. Many hearings can be handled remotely or by your attorney. We will tell you what your case requires.
Which areas of California do you serve?
We serve clients throughout California, with a focus on the Central District and Southern District, and we also handle matters in the Northern and Eastern Districts.
